Town Board Meeting held June 8, 2009 at 7:00 P.M. at the Town Hall in Schroon Lake N.Y.

Supervisor Moses called the meeting to order at 7:02 P.M. with a Pledge to the Flag.

Grant Award

Supervisor Moses stated that she was pleased to announce that the Town of Schroon had received a 4.4 million dollar grant from stimulus money to finish phase two of the Sewer Project. The project will complete the following: Rogers Brook sewer line replacement, Northend transmission from Olden Drive, Southend into Pump Station #1- Both the West side and East side of Rt. 9, Dock Street Pump Station, Horse Shoe Pond Pump Station and a UV disinfection system.

Resolution #130 Varsity Boys Baseball Team

CONGRATULATING THE SCHROON LAKE

CENTRAL SCHOOL

BOYS VARSITY BASEBALL TEAM

The following resolution was moved, seconded and carried unanimously

WHEREAS, the Town Board of the Town of Schroon was pleased to learn that the Schroon Lake Boys Varsity Baseball Team and Coach Sharp have gone undefeated and won the 2009 MVAC League Championship which has not been done since 1977, and
WHEREAS, the Town of Schroon Board was pleased to learn that the Schroon Lake Boys Varsity Baseball Team is ranked No. 1 in the Class D School in the state, and

WHEREAS, this is the first time in twelve years that the Boys Varsity Baseball Team has won the 2009 MVAC League Championship and thirty-two years since they have gone undefeated, and

WHEREAS, The fans and parents of this incredible team have been sitting on the edge of there seats all season and have enjoyed the memories of the games, the laughing and crying, the Mohawks, the injuries and Coach Sharp yelling “Here we go now… here we go!”

NOW, THEREFORE, BE IT RESOLVED that the Town Board of the Town of Schroon hereby stops in their deliberations to extend its most sincere congratulations and states how proud we all are of your accomplishments

Essex County Household Hazardous Waste Collection Day

Supervisor Moses stated that there will be an Essex County Household Hazardous Waste Collection Day on Saturday August 1, 2009 from 9 A.M. – 1 P.M. at the Essex County Landfill, information may be obtained from the Town Clerk.

Resolution #131 Approval of Minutes

Councilman Whitney moved a resolution to accept the May 11, 2009 minutes with a correction from Councilman Friedman with the spelling of the name Dewine it should be Dewein and under the Crack filling machine the words if and more will be added, seconded by Councilwoman Phibbs; carried.

Resolution #132 Relay Installation at Ski Tow

Councilman Whitney moved a resolution to have Harold Karaka install the relay switch at the ski tow as long as it does not take more than two hours, seconded by Councilman Haroff; carried.

Resolution #133 Audit of Claim

Councilman Haroff moved a resolution to accept the bills to be paid as reviewed, seconded by Councilwoman Phibbs; carried.

PROCLAIMING VELMA GOCHIE
AS SCHROON LAKE'S “2009 SENIOR CITIZEN OF THE YEAR”
WHEREAS, each year the Schroon Lake Senior Citizens honor one of their seniors as “Senior Citizen of the Year”, and/
WHEREAS, the Town Board of the Town of Schroon also wishes to honor this year's Senior, and/
WHEREAS, it is no surprise to this Town Board that Velma has received this honor for a second time as we are all well aware of Velma's contributions not only to our Senior Citizen Center, but as a member of various organizations including the Fish & Game Club and the Ladies Auxiliary at the Schroon Lake Fire Department, and/
WHEREAS, Velma will always be remembered for her Christmas Angels, her crocheting, and especially for her delicious baking skills and her generosity with those “goodies” of which of course she takes all of the calories out, and /
WHEREAS, Velma's pleasant smile and great sense of humor has kept smiles on many members of our community over the years,/
NOW, THEREFORE, BE IT RESOLVED that the Town Board of the Town of Schroon extends its sincere congratulations to Velma Gochie for her many years of dedication to the Senior Citizen Club and to our community.

Resolution #135 Congratulations to Citizen of the Year

*DECLARNG JUNE 16, 2009 AS “ED DONLEY” DAY *
*IN THE TOWN OF SCHROON*

WHEREAS, each year the Schroon Lake Chamber of Commerce names a new “Citizen of the Year”, and
WHEREAS, each year when I see the list of nominees, I wonder “How in the world am I going to vote” as our community is so fortunate to have such great candidates, and
WHEREAS, this year was no exception as the candidate could not have been a better choice, as anyone who knows *“Ed Donley”* knows that he is one person they can always count on, and
WHEREAS, even within the past couple of weeks Ed, along with his friend Bob Yoeckel, jumped to my rescue when I had no one to set up the sound system for an event. There wasn't even a question, the help was there, and
WHEREAS, the first name that comes to my lips when someone calls Town Hall looking for a lifeline connection is Ed Donley, and
WHEREAS, Ed has given selflessly to the Schroon Lake Ambulance Squad as a crew member, first responder, and emergency technician, along with his dedication to the Schroon Lake Senior Citizen Club; the Schroon Lake Lions where he received the Melvin Jones Dedicated Humanitarian Service Award, the Lions highest honor; the Schroon-North Hudson Historical Society; the Oscar Seagle Association; the Schroon Lake Fish & Game Club, and
WHEREAS, when asked to serve on the Schroon Lake Park Commission as an alternate member, was there even a question of whether or not he should serve? Not from Ed. He was there for us again , and
WHEREAS, anyone who sees Ed dressed in his uniform as the Commander of the Schroon Lake VFW and Vice Commander of the American Legion can see the face of true patriotism and pride in his town and in his country - always ready to *“SERVE”,*
NOW, THEREFORE, BE IT RESOLVED that the Town Board of the Town of Schroon extends its most sincere gratitude and appreciation for the service of Ed Donley, for his recognition as the 2009 Citizen of the Year, and we hereby declare June 16, 2009 *“ED DONLEY DAY”* in the Town of Schroon.

Date to Coordinate July 4th Event and Waste Water Workshop Date

Supervisor Moses stated that they needed to set up a date for coordinating the July 4th Event with the Fire Dept., NYSP, Essex and Warren County Sheriffs Dept., Highway Superintendent, Roger Peace from Word of Life, Joan Cunningham and Dave Clark and the Town Board it will be Wed. June 24, 2009 at 7:00 P.M. at the Fire House.

The Waste Water Workshop will be Wed. June 24, 2009 at 5:00 P.M. at the Town Hall Meeting Room.

Resolution #136 Care of Town Flowers

Councilman Phibbs moved a resolution to hire June Dennette for the job of caring for the flowers for a stipend of $800.00, seconded by Councilman Friedman; carried.

Resolution #137 Consider Internet and T.V. Service at Golf Course

Councilwoman Phibbs moved a resolution to wait on the hook up for the Internet Connection and the Cable T.V. until they see if they can make a profit at the Golf Course to pay for it, seconded by Councilman Haroff; carried Councilman Whitney was opposed.

Resolution #138 Golf Course Instructor

Councilman Friedman moved a resolution to advertise for a Golf Instructor for the Youth Commission Golf Program paying a stipend of $120.00, seconded by Councilwoman Phibbs; carried.

Resolution #139 Paradox Lake Milfoil Assistance

Councilman Friedman moved a resolution to pay for the harvesting of the milfoil on Paradox Lake but to take it back to Steve LeMere to make sure that the word “control” means the same as “harvesting” before the Board pays $3,300.00 to the Paradox Lake Association, seconded by Councilman Haroff; carried.

Crack Filling Machine

Highway Superintendent Dana Shaughnessy would like to wait on purchasing a Crack Filling Machine until he has more information and prices which he will present it at the next Board Meeting.

Airport Hanger Door Construction

Supervisor Moses stated that she will be advertising for a Request for Proposal on the Airport Hanger Door.

Resolution #140 Facility Use Request

Councilman Friedman moved a resolution to accept the Facility Use Request for a 20 Year Class Reunion to be held at the Hockey Rink on July 3, 2009 starting at

3:00 P.M., seconded by Councilman Haroff; carried.

Resolution #141 APA Map Amendment Proposal

Councilman Friedman moved a resolution to hire the L.A. Group to do the proposed study needed to support the APA Map Amendment for the property currently owned by Stapley and Slaterpryce, seconded by Councilman Haroff; carried.

Councilman Haroff moved a resolution to amend Resolution #141 to have the property owners pay for the proposed study needed to support the APA Map Amendment and not the Town of Schroon , seconded by Councilman Friedman; carried

Seagle Colony Sign

Councilman Friedman stated that he had contacted the APA and DEC and neither of them have jurisdiction in this matter. He then went to DOT and spoke with Rick Gero and he told him it was up to the Town of Schroon and that the sign had to be 36’ from the center of the line. Councilman Whitney suggested that the Town charge a fee for the use of the property and to see if that was even legal to do. Supervisor Moses said she would check in to that and get back to the Board.

Resolution #143 Waste Water Hook up

Councilman Whitney moved a resolution to approve the request from the Krah’s to put in a new service line connection to the town sewer line for there property at 1124 US Route 9, work will be completed no later than June 26th, one week in advance of the 4th of July, seconded by Councilman Haroff; carried.

Resolution #144 Power Pole Street Light

Councilman Friedman moved a resolution to allow a street light to be put back up again, located between 46 and 48 Brookfield Avenue, as National Grid had taken down the pole and never put it back up. The Palmers are requesting to install it across the street, seconded by Councilwoman Phibbs; carried.

RESOLUTION REQUESTING THAT THE NEW YORK STATE
DEPARTMENT OF ENVIRONMENTAL CONSERVATION RECONSIDER
THEIR OPPOSITION TO CONTROLLED BURNING SITES IN ESSEX
COUNTY TOWNSHIPS
The following resolution was offered by Supervisor Moses, which was moved unanimously.
WHEREAS, the New York State Department of Environmental Conservation has
allowed controlled burning of debris, blow down and other materials at our transfer sites;
and
WHEREAS, it has come to the attention of this Board that the New York State
Department of Environmental Conservation has decided that they will no longer allow
controlled burning at our transfer sites; and
WHEREAS, it is the opinion of this Board that to discontinue controlled burns at our
transfer sites will result in private citizens attempting their own burns under circumstances which may not be as safe to the general public and may well result in the dumping of debris along State, County and Town roadways as an alternative to burning.
BE IT RESOLVED that the Town of Schroon hereby strongly urges the New York State Department of Environmental Conservation to reconsider their opposition to controlled burn sites in the townships and to continue to allow controlled burns at and in Town and County transfer sites.
BE IT FURTHER RESOLVED, that a certified copy of this Resolution be forwarded
to the Commissioner of the New York State Department of Environmental Conservation
as well as to the New York State Department of Environmental Conservation at Ray Brook, New York.
This resolution was unanimously moved and seconded and duly adopted.

Public Participation

Charlie Smith wanted to know what would happen if the DEC does not allow burning at the Transfer Stations in Essex County? Supervisor Moses stated that there was nothing they could do and suggested to everyone to write a letter to DEC in Ray Brook, New York.

Board Comments

Supervisor Moses stated that the next step to cleaning up the corner of Route 9 and Hoffman is to hire an attorney but she would like Don Sage to come to the next Board Meeting an explain the situation to the Board.

Councilman Friedman stated that he would like to thank Chris Stone for all her hard work on calculating all of the Milfoil Grant and for all the many volunteers who help make it a success. Councilman Friedman stated he had written Michael Fayette from DOT requesting that the existing highway signs at both Exit 27 and 28 of the Adirondack Northway have additional signage installed pointing with an arrow in the proper direction to the Schroon Lake Business District. Due to a lack of clarity, the existing signage offers arrows and various indications, but no where is the actual Business District of the Town of Schroon recognized. Especially in times like these the Business District needs all the help it can get.

Executive Session

Councilman Haroff moved to go into Executive Session at 9:05 P.M. to discuss possible Landfill allegations and possible employee disciplinary issues, seconded by Councilwoman Phibbs; carried

Councilman Haroff moved to come out of Executive Session at 9:50 P.M., seconded by Councilman Friedman; carried.
