Regular Town Board Meeting held August 11, 2008 at 7:00P.M.in the Town Hall in Schroon Lake N.Y.

            The meeting was called to order at 7:03 P.M. with the Pledge to the Flag.

Public Participation

            Councilwoman Phibbs wanted to thank the Board and everyone for their concern and help while she was sick and stated it was a pleasure to work with them all.

            Supervisor Moses stated that D.E.C. had given the Sewage Treatment Plant permission to accept limited volumes of septage from Larry Sheills Septic Service and limited volumes of liquid sludge from Word of Life Island WWTP which will help with revenue going to the sewer district.

            Supervisor Moses stated that the State Board of Real Property Services established a final State equalization rate of 100% for the Town of Schroon.

Resolution #175 Approval of Minutes:

            Councilman Friedman moved a resolution to accept the minutes of the July 14, 2008 Special Town Board Meeting, seconded by Councilman Marnell; carried Councilwoman Phibbs abstained.

            Councilman Whitney moved a resolution to accept the minutes of the  July 14, 2008 Regular Town Board Meeting, seconded by Councilman Friedman; carried Councilwoman Phibbs abstained.

            Councilman Whitney moved a resolution to accept the minutes of the  July 21, 2008 Special Town Board Meeting, seconded by Councilman Friedman; carried Councilwoman Phibbs abstained.

 Resolution # 176 Audit of Claims

Councilman Whitney moved a resolution to accept the bills to be paid as reviewed, seconded by Councilman Friedman; carried Councilman Marnell abstained.

Resolution #177 Increase in Marriage License Fee

            Councilman Friedman moved a resolution to increase marriage license fees from $30 to $40. seconded by Councilman Whitney; carried.

Resolution #178 Permanent Appointment of Codes Enforcement Officer

            Supervisor Moses moved a resolution to hire Don Sage as permanent Code Enforcement Officer at the annual rate of $30,149, seconded by Councilwoman Phibbs; carried

Bandstand Deck

            Supervisor Moses stated that the decking on the Bandstand was leaking and she contacted the Contractor Robert Spellacy who installed the deck. He stated that at his own expense, he would take up the decking  and refund the labor cost. Councilman Marnell suggested that the Town of Schroon put a protective seal on the decking to see how that would work.  Councilman Marnell and Supervisor Moses will meet with the contractor to discuss sealing the deck before pulling up the decking.  Councilman Whitney stated he would like to see us accept his refund and have it sealed if the contractor thinks that will work.  He stated we need to look at the contract.

Advertise For Sale of Water Truck

            Supervisor Moses will see what the loan value will be from the Bank and also check Blue Book before advertising.  It may be a truck the Town of Schroon will use in another department.

Lease with T – Mobile

            Supervisor Moses went up to the site to see where the lines would be and felt they could be marked a little clearer. She will contact T – Mobile to come again and mark it out so that the Board may look it over.  A Workshop will be set at a later date to discuss a contract.

 Resolution #179  Zoning Board of Appeals Minutes

            Councilwoman Phibbs moved a resolution to accept the minutes from the Zoning Board of Appeals, seconded by Councilman Friedman; carried.

Hanger Lease Agreement

            Councilman Friedman moved to discuss the Hanger Lease Agreement, seconded by Councilman Marnell; carried.  Councilman Friedman and Councilwoman Phibbs had concerns looking over the contract.  The following suggestions were made, a one month security deposit,  a maximum of two planes in the Hanger, length of lease, no subletting.  Councilman Friedman moved to table it , seconded by Councilman Whitney; carried.

Resolution #180 Proposal for Painting Street Lights

            Councilman Whitney moved a resolution to accept Tim Botterbusch to paint the street lights for $5900 with materials being supplied by the Town of Schroon if it is legally permissible under our local laws to do so, seconded by Councilman Marnell; carried.

Resolution #181 Affordable Housing / Reclassification Process

            Richard Schoenstadt addressed the Board and the public on wanting to reclassify the area behind Slatterpryce Trailer Park and north of there.  The A.P.A. will allow one home per 3.2 acres at the present time. The Town of Schroon Planning Board would like to propose that the area be considered a Hamlet Area which allows one home per 10,000 square feet. There was much discussion. The Request for Proposal outline is as follows. 

Part C of Application, Item #4A: Task for Consultant

Using a USGS topographic map as the base map, show the location of nearby existing potable water lines, sewer lines and water and sewer districts.  

 

Part C of Application, Item #4D: Task for Consultant

Perform a site visit to verify soil map units if any of the map units could contain a seasonal high groundwater table that is less than 24 inches deep.  Correct existing USDA Natural Resource Conservation Service soil maps if needed and note these corrections on the maps.  This map should be placed on an 11x14 sheet and an appropriate scale should be chosen to fill the sheet.  Additional site maps showing features (slope, wetlands, etc.) of the site must use the same scale.

 

Part C of Application, Item #4E: Task for Consultant

Using the USGS 10 meter DEM data, calculate and show the following slope classes on the USGS base map:  0-8%, 9-15%, 16-20%, and >20%.  Perform a site visit to verify presence or absence of ponds, perennial and intermittent streams.  Show these features on the USGS base map if not already present

 

Part C of Application, Item #4H: Task for Consultant

Determine if Official APA Wetland Maps show wetland on any of the parcels under consideration.  Verify the presence or absence of APA jurisdictional wetlands during a site visit and include results on a USGS base map.  Note dominant indicator species if APA jurisdictional wetlands are found.

 

Councilman Friedman moved a resolution to go ahead to have Alan Hipps, at his own expense,  do a request for proposal on creating affordable housing from a land developing firm to give us estimates on reclassification of land according to the task in the outline presented, seconded by Councilman Marnell; carried.

Resolution # 182 Planning Board Members

            Councilman Friedman moved a resolution to accept Larry Phillips request from alternate Planning Board Member to full time. Larry will replace Bruce Caza and his term will expire December 31,2012, seconded by Councilman Marnell; carried.

            Alan Decesare requested to be an Alternate on the Planning Board replacing Larry Phillips and his term will expire December 31, 2011, unanimously moved and carried.

Resolution # 183 Generator for Sewer Plant

            Jim Roblee needs to replace the 1989 Coleman generator for Tannery Lane and purchase a new one,  Jim got three quotes. 

1.  Northern Tool  Honda 6500 watt $2700 plus shipping

2.  USA Blue 6500 watt $3095.95 plus shipping

3.  USA Blue 6500 watt Quite Series $3950.95 plus shipping

The Board asked Supervisor Moses to check locally with Dave Whitty Sales and Services to see what their cost would be.  Councilwoman Phibbs moved a resolution to have Supervisor Moses as a Board Directive to  purchase a generator for Tannery Lane, seconded by Councilman Marnell; carried.

Comments from the Board

            Councilwoman Phibbs stated that she would like to know from the Highway Superintendent, Dana Shaughnessy, how his budget is going as far as fuel expenses with the highway vehicles.  Dana will check with Chris Stone what is left in his budget.

            Councilman Whitney stated he would like to know what the estimate revenue for sludge collection is for the Sewer Department.  Councilman Whitney stated the Schroon Lake Association is looking for people to report any Milfoil on the lake they would be Milfoil Scouts.

            Councilman Marnell would like to address the property of Mohammed Badruddin and the Youngs property and that Don Sage follow up and enforce the Town Ordinance and any expenses incurred should go onto their tax bill. 

            Councilman Friedman would like to thank ARCH and the Historical Society for their tour of the town and pointing out the style of homes in our area. They did a wonderful job and it was a great effort on all who made it possible.

Public Participation

            Henry Tyska wanted to know why there was such a differents between Essex County and Warren County on the gasoline prices.  Supervisor Moses stated that there is no competition in the area like there is in a bigger area such as Glens Falls.

Resolution #184 Special Town Board Meeting

            Councilman Whitney moved a resolution to have a Special Board Meeting at 6:00 P.M. on September 4, 2008 to have Allen Hipps come down from the county to discuss Affordable Housing and to change the Regular Board Meeting from Sept. 8, 2008 to Sept. 4, 2008 at

 7:00 P.M. seconded by Councilwoman Phibbs; carried.

            Councilman Whitney moved to adjourn at 10:10 P.M., seconded by Councilman Marnell; carried.
