Town Board Meeting held November 13, 2006, at 6:00 p.m. at the Town Hall, Schroon Lake, New York

Present:           

Supervisor:             Catherine L. Moses

Councilmen:            Roger Friedman, Donald Sage, Sharron Tyrrell, Clara Phibbs

Hwy. Super.:            Michael Marnell

Town Clerk:            Janice Tyrrell

Also Present:            List Attached

     The meeting was called to order with Town Attorney Randy Parker in reference to pending litigation.

      Sharron moved a resolution to go into Executive Session, seconded by Clara; carried.

     At 7:40 PM Roger moved a resolution to come out of Executive Session.

     At 7:40 PM the meeting was recessed until 3:00 PM on Friday November 17^th at which time council

would be obtained for litigation.

     On November 17^th the recessed meeting of November 13^th  was called back to order.

     At 3:07 PM Sharron moved a resolution to go into Executive Session to discuss a legal case, seconded

by Roger; carried.

     Don moved a resolution to come out of Executive Session at 3:40 PM, seconded by Sharron; carried.

     A unanimous vote was cast to retain Hacker & Murphy LLC for litigation on assessment, with funds to

come from Fund Balance.  It was unanimously seconded.

     Don moved a resolution to appropriate $50,000 from Fund Balance for legal use, seconded

unanimously.

     Roger moved a resolution that the Town has no objection of the school and county retaining the same

firm for legal action, seconded by Don; carried.

     Don made a motion to adjourn meeting at 3:14 PM, seconded by Sharron carried.
