3. Thursday February 11 2010.  Engineer for project owner discussed a proposed plan.  Project owner has had preliminary discussions with DEC and NYS State Health Department regarding their role in the project review and approval.  No formal application has been filed yet.

4. March 11, 2010 meeting.    

 

A.   Report on ZBA appeal.  The owner was granted permission to have property on both sides of Davis Road to be considered as one property for the purpose of determining the overall project density.  This decision does not increase the amount of allowable development but permits the development rights attached to 12,000 sf of land on the west side of Davis Road to be used on the lake side of the property if the owner so chooses.

 

B.   After discussing it numerous times at previous meetings, the planning board formerly voted to permit the use of "double density" zoning.   This is permitted where off lot (centralized collection of sewage) is present and off lot water is present.   This project will be supplied by town water.  The sewage will be collected and sent to a centralized package treatment plant.  It is yet to be determined what will be done with the treated effluent.  There are a number of options that will be considered.  Furthermore this approval is conditional upon the following.

An acceptable package treatment plant must be found and approved.  An acceptable location must be found for the plant.  Additionally an acceptable location must be found for the disposable of the effluent.  If this is all achieved, then the owners plan of a restaurant, 35 motel/hotel rooms and 35 condominiums - will be allowable

as far as the overall density requirement is concerned.   By the way  this overall density calculation excludes an estimated acre of land that will be required for the treatment plant placement and septic effluent disposal. 

Currently finding an acceptable system etc is a main if not the main focus of concern.  These systems are very widely used elsewhere.  

 

C.  The planning board officially voted to permit the use of cluster development for this project.  Again this was after having discussed the issue numerous times at previous meetings.  Cluster zoning does not change the overall density but waives the basic lot size and area requirements.  It permits flexibility in terms of design and allows layouts that would not otherwise permitted.

 

D.  We discussed Seqra and how to apply it to this project.  The town has a town law regarding Seqra which states that any project that is not a class A or class B regional project is a type project 2 project by definition and as such does not require any further environmental review.  This is not a class A or Class B regional project. 

Therefore according to town law as we interpret it the project does not require any further review under Seqra.  Nonetheless we are going to use the Seqra criteria within the context of the Subdivision Rules and Regulations to review the project including all required notifications. 

 

E. Mr. Locascio filed an application on March 12, 2010.   At this stage this is a very basic form that we requested he file in order to formerly get the process started.

 

F.  Mr. Locascio aslo submitted a revised plan at the same time.   Click here to see the newest plan. 

G.  June 10, 2010 A presentation of the latest plan was made by the engineers for the project.  Additionally a presentation was made by the representative of Orenco

The planning board approved the use of the Orenco system as an acceptable treatment system equal to if not superior to standard package treatment plants.  However a suitable place for the treatment system still needs to be determined and a suitable location for the disposal of the treated effluent has yet to be determined.  Additionally issues regarding noise and odor have to be satisfactorily addressed.

DEC has review authority regarding the septic system.  A revised plan was submitted that was not substantially different than prior plans.  Please note that these are still preliminary plans subject to revisions based on a number of review considerations. This plan has already been modified. 

H.  March 20, 2011 Update -- The following have been submitted to DEC for their review

Please note that the planning board has approved no plan and that considerable review by the planning is still required before any final plan is approved.

DEC's review is limited to the septic and water system.

May 19, 2011 -- the latest plan was reviewed in some detail. 

August 28, 2011 -- DEC has completed their Seqra review.  The project is an unlisted action.  DEC has issued a negative declaration. Also the developer has completed the application for a SPDES permit for the septic treatment and disposal system which DEC is now reviewing.

November 10, 2011 7PM -- A public hearing will be held to review the project.

(November 14, 2011) Details of hearing will be forthcoming.  Meeting was recessed without any decision.  Follow up meetings are scheduled for December 1 at 7 pm and December 8th if necessary.  We expect to vote on the project on December 15.
